FitКit offers services through several of its companies in the countries of the region (hereinafter: “FitKit”, “we”).

This Privacy Policy aims to describe our practices for collecting, using, disclosing, and processing your personal data that Fitkit collects from individuals who visit and use our web platform (www.fitkit.app) and/or mobile application (“FitKit App”), as well as from other individuals whose personal data is used to provide our services and in connection with the use of our products.

When you register to use Fitkit’s services or book specific fitness/wellness activities through the Fitkit application or web platform, or other cooperation, the controller of your personal data for those specific services is the FITKIT company that provides you with the services in your country of registration or use.

Sources of Your Personal Data

FitКit collects personal data that you provide to us by establishing direct contact with us and/or registering to receive promotional material from us, as well as by using our website, our application, and the services and products we offer you. The personal data we collect when you create your profile on our FitKit App application is used to maintain your profile, to provide our products and services to you, and to achieve and improve your experience in using our platforms and services.

We may also collect personal data for users of the FitKit application and FitKit services from third (legal) parties, when cooperation is established for the use of the FitKit application and FitKit services on behalf of employees and/or clients of legal entities.

We also collect and process personal data from providers of services and goods with whom we cooperate to achieve and improve the products and services we offer to our users, with the aim of enabling a complete program that will contribute to improving the fitness condition of our users in various aspects.


Categories of Personal Data We Collect About You


While you use our platforms, products, and services, we may ask you for information by which you can be identified, such as (but not limited to) your data:
Data for users of our services: first and last name, home address, gender, date of birth, financial data and credit card data, personal photo, social media profile (only for users who log in to FitKit using Facebook). We use your contact data (email and phone number) for registration and account management, service delivery and important notifications, content customization according to your location, account protection and fraud prevention, customer support, as well as for marketing purposes with your explicit consent.

Data about your use of our platforms, application, and services (user data, i.e. data about user activities and profile). This may include information that a minor uses certain services through your profile/account. However, this does not include the collection and processing of data that can identify the minor.


Special Categories of Personal Data


Booking psychological services through the application involves processing sensitive mental health data, which, as a special category of personal data, is strictly protected by personal data protection regulations.


FitKit processes this data solely for safe and efficient scheduling and facilitating the use of the selected service, and we do not have any additional data regarding your health and sessions.

Data for authorized persons and employees of suppliers, service providers who are legal entities: first and last name, address, contact data (email, phone number), job position, legal entity, type of contract and service, data for service provision.

Data for individual service providers, such as engaged trainers: first and last name, address, unique master citizen number (EMBG) according to law, payment data, type of contract and service, data for service provision, financial and tax data, photos and videos for training program purposes, social media profile.


User Data (User Activity and Profile Data)


Data about your user profile and your (online) user activities are collected automatically when you use our platforms, products, and services.

Data about your user activities may include information about the IP address of your device from which you log in to our platforms, the type and version of the browser you use to access our platforms and services, the pages you use on our platforms, the date and time you log in to our platforms, as well as the duration of your visit to our platforms, unique identifiers of your device from which you log in, and other diagnostic data about your online activity on our platforms and access to our services.

When you access our platforms and services via a mobile device, we may automatically collect certain data, including the type of mobile device you use, the unique ID of the mobile device, the operating system of the mobile device, the type of mobile internet and browser you use, and other identifiers and diagnostic data for your mobile device.

We may also collect data that your browser sends every time you access and use our platforms and services.


Data We Collect from Third Parties – Social Media


We may collect and use personal data that you have shared by creating a profile and/or by otherwise acting in the public domain with third parties – social networks. We may also initiate communication with you through your profiles on third parties – social networks for the purpose of establishing initial communication and potential cooperation with you.


Also, you can create an account and log in (access) to use our platforms and services through your social media profile or when you share them with us as part of testimonials about your positive user experience with our programs and services.


Data We Collect While Using the FitKit Application


When you use our FitKit application, we may, with your prior permission/consent, collect information about your (geographic) location to enable you to better and easier use all the features of our application, and to improve, perfect and adjust the application and the products it offers, as well as other services we offer you. You can allow or disable access to such data at any time, by adapting the settings of your mobile device.


Tracking Technologies and Cookies


When you visit our platforms, use the FitKit application, register for and use your user profile, or request further information about Fitkit platforms and services, we automatically collect data using cookies and tracking pixels. We and our partners use such collected data to analyze the movement on our platforms and trends in the use of our products and services, to manage our online platforms (websites, applications, social media profiles) – independently or with the help of hosting service providers, as well as to collect data about users of our services and platforms.

Technologies we use to track activities on our platforms and collect information needed for analysis, evaluation, and improvement of our platforms and the services we offer you may include: beacons, tags, and scripts. Purposes of Using Your Personal Data


We may use your personal data for the following purposes:

For providing and maintaining our platforms and services, including monitoring the use of our products and services.

For maintaining your profile in our application: for carrying out your registration and managing your profile as a user of our platforms and services. The personal data you provide to us when registering a FitKit profile gives you access to various functions, products and services of the FitKit application.


For concluding and fulfilling a contract (exercising contractual rights and obligations): 

For concluding and acting on a service contract, work contract, and other contracts that we conclude with collaborators for the provision of the products and services we offer you, as well as other contracts that we conclude for maintaining our platforms and providing our services and products. For access to, and use of, certain products on the Fitkit application, we may ask you to provide us with additional personal data.

For communicating with you: To contact you by email, phone, SMS, or otherwise through an equivalent model of electronic communication (for example, through notifications via the Fitkit application) to inform you about updates to the services you use, or for other types of informational communication regarding the functionality of our products and services you use through our platforms (including information about updating security systems).

To manage and respond to your requests: To receive, review, resolve, and respond to your requests addressed to us.

For promoting our services and activities by sharing your experience of using the services through our website or social media.

To deliver targeted marketing offers to you: We may use your personal data to develop and place promotional material (information, special offers, news) for other products, services, and events that match your interests and preferences, and/or location, but only if you have previously voluntarily agreed to such processing during your registration as a new user or when using your online profile. If you wish not to be subject to targeted marketing, you can withdraw your consent at any time via a special link in the marketing message itself or send us a request, via the following online form or to the following email: info@fitkit.app.

For the purposes of participating in the FitKit Fit Rewards Program and giving gifts (“Program”)

By accepting the challenges and actively collecting points by clicking the “Collect” button in the application, you agree to participate in the Program and for your personal data to be processed for the following purposes: monitoring the progress of your daily and monthly challenges, awarding points and gifts, inclusion in the ranking of top participants (top list) and analysis of participation in the Program for its improvement. You have the right to withdraw consent at the following contact email info@fitkit.app, which will not affect the lawfulness of processing carried out before the withdrawal.

The registered username, profile picture, and earned points will be publicly displayed on the top list of best participants as described in the Terms of Use and Terms of Purchase. Participants’ personal data will be completely deleted or anonymized 3 months after the end of the Program or the withdrawal of consent, whichever occurs first.

For other purposes: We may use your personal data to conduct data analysis, identify trends in platform and product usage, measure and determine the effectiveness of our promotional campaigns, as well as other activities aimed at evaluating and improving our services, products, marketing, and your experience when using our platforms, products and services.


Legal Bases for Processing Your Personal Data

We may process personal data in the following cases, i.e., based on:

Consent: You have given us consent to process your personal data for one or more specific purposes, such as for direct marketing of services and products, sharing your experience as a user. When paying in the FitKit application, you can, with your explicit consent, save your payment card data in tokenized form for future purchases; while when paying for subscriptions, by activating the subscription, the user gives consent to save payment data in token form, which is necessary for automatic and recurring billing. FitKit does not store the full card number, CVV/CVC, or expiration date on its servers, but only a unique reference (token) from a specialized payment service provider (PSP), along with the last 4 digits and the card type. You have the right to withdraw the given consent at any time, after which all stored tokenized data will be deleted, and enhanced authentication (SCA) provides additional security for transactions.

Fulfillment of a contract: The processing of personal data is necessary for the fulfillment of a contract we have concluded with you, including for all pre-contractual rights and obligations preceding the conclusion of such a contract.

Legal obligations: The processing of personal data is necessary for Fitkit to fulfill its obligations according to law, such as tax obligations or requests from state authorities according to law.

Legitimate interests: The processing of personal data is necessary for Fitkit’s legitimate interests, such as protecting business operations and the website (detecting problems, data analysis, testing, security and support of systems and applications, data hosting and reporting), managing and cooperating with service providers, conducting legal proceedings for collection, improving our services, products.


Disclosure and Transfer of Your Personal Data to Third Parties


With service providers: We may share your personal data with service providers with whom we cooperate, including for maintaining our platforms and services, for processing payments for the use of our services and products, production companies or telecommunication operators for recording and displaying video materials.
With collaborators: We may share your personal data with our collaborators, who are obliged to act in accordance with this Privacy Policy, such as IT consultants and developers who help us in maintaining and upgrading the Fitkit application.

For creating promotional content: We may share your personal data with marketing agencies and other service providers with whom we cooperate for creating and sending promotional content to you personally via email and/or for creating our promotional material and marketing offers that would appear to you when you use third-party platforms.


With business partners:

To provide you with access to a wide range of fitness and wellness services (such as sports centers, fitness studios, swimming pools, individual trainers, and other legal entities whose premises, products, and services you use through the application), we cooperate with various business partners-service providers.

When you book an appointment or service with one of our partners through the application, it is necessary to share certain of your personal data with that partner. The purpose of this sharing is to enable the partner to confirm your identity upon arrival and to ensure and verify in our system that you have used the booked appointment.

The data shared for this purpose includes your first and last name, profile photo, phone number, and unique code for the service/appointment.

The legal basis for this sharing is the performance of the contract you have with us (to enable you to use the booked service), as well as the legitimate interest of our partners to verify the presence and use of their services.

With all our service providers and partners, we have concluded appropriate data processing agreements, which guarantee that your data will be protected, treated confidentially, and used exclusively for the stated purposes, in accordance with GDPR and applicable national personal data protection regulations that apply to the contracting parties.

With other users: We may share your personal data that we have obtained through your public domain activities with other users and third parties – social networks. This is limited to personal data that is publicly available on your social media profiles (name, photo, description of your activities on the platform), and for the purposes of achieving and/or improving communication and cooperation with you, sharing user experience.

Based on law and other legally binding demands: In some circumstances, we may be obliged to share your personal data at the request of law and/or public authorities (courts, government agencies, enforcement officers). We may share your personal data when it is necessary for exercising and acting on our legal obligations, protecting and defending our rights and property, preventing and/or investigating (possible and/or potential) abuse in relation to our platforms, products and services, protecting the personal safety of our users/clients and/or public safety, acting on our legal duty and responsibility.

Our relationship with third parties is governed by a Contract, which regulates all rights and obligations regarding personal data protection and technical and organizational measures for the security of your personal data.


Transfer of Your Personal Data to Third Countries


Your personal data may be transferred to third countries outside the European Union and the European Economic Area – for example, to our parent company Fitkit International DOO, Skopje in the Republic of North Macedonia, for the purpose of providing administrative, technical or operational support related to our business activities.

Regardless of whether you are a user from the European Union or another country, we commit to ensuring that every transfer of personal data to third countries is carried out in accordance with applicable personal data protection regulations. For this purpose, we conclude personal data processing agreements with recipients in third countries, which regulate the transfer and processing of data. These agreements may contain standard contractual clauses approved by the European Commission or another supervisory body for personal data, which provide an adequate level of protection.

When you subscribe to or purchase services through our mobile application, and to ensure the highest standards of data protection and compliance with the General Data Protection Regulation (GDPR), we cooperate with a specialized service provider registered in the EU, to securely and efficiently process your transaction and payments.

FitКit stores your personal data in ways and for purposes defined by this Privacy Policy for the duration necessary to achieve the defined purposes, unless the law permits or requires their storage for a longer period.

When your personal data are no longer needed for the purpose for which we collected and processed them, we delete them in a timely and secure manner.

We may continue to store your personal data longer than the specified retention period if this is necessary for the exercise of your and our legal and contractual rights and obligations, as well as for resolving disputes and exercising rights and obligations we have towards third parties, for the exercise of our legitimate interests (for example, for achieving business goals, improving our products, maintaining market competitiveness, conducting legal proceedings, etc.), as well as for aligning our security measures and standards regarding the security, integrity and operability of the Fitkit application and our other platforms, services, and products.

Your data may be subject to automated decision-making based on information about your preferences, previous interaction with us, and use of services or demographic data to deliver marketing offers that best suit your interests, but only with your prior consent.

The right to access your personal data, and also the right to receive a copy of the data about you that we store and use;

Sending such a request is free of charge, and its processing will incur additional costs only in exceptional circumstances.
