  1. Introduction

We Fitkit International D.O.O. Skopje (“Fitkit”) are strongly committed to protect your privacy. This Privacy Policy (“Policy”) outlines the practices and procedures for ensuring your privacy that we at Fitkit (“Company”) undertake when processing personal data collected and used from individuals who visit our web platform (www.fitkit.app) and/or mobile application (“Fitkit Application”), and from other individuals whose personal data is used to provide our services and in connection with the use of our products (“Services”, “Products”).

Fitkit may adopt and provide additional privacy and data security policies that will apply to specific products or services at the time we collect personal data to provide such services.

Fitkit International D.O.O. Skopje (“Fitkit”), with registered office at No. 5/1-30, Vangel Todorovski Str., Skopje – Aerodrom, Republic of North Macedonia, in the role of data controller collects, processes and stores your personal data.

Fitkit collects personal data that you provide when establishing direct contact with Fitkit and/or registering to receive promotional material from Fitkit, as well as when using our website, our application and the services and products we offer. The personal data we collect when you open your account on Fitkit.app is used to maintain your account, to provide our products and services to you, and to enhance and improve your experience using our platforms and services.

Personal data of the users of Fitkit application and Fitkit services may be collected from third parties (legal entities) when cooperation is established for using the Fitkit application and Fitkit services on behalf of the employees and/or customers of the legal entities.

We also collect and process personal data from service and goods providers with whom we cooperate to realize and improve the products and services we offer to our users, with the goal of providing a comprehensive program that will contribute to improving the fitness condition of our users in various aspects.

While using our platforms, products, and services, we may ask you for information that can identify you, such as (but not limited to):

  • Data regarding the users of our services: name and surname, residential address, gender, date of birth, ID card number, contact details (email and phone number), financial and credit card data, personal photo, social media profile (only for users who log in to Fitkit using Facebook)
  • Data regarding your use of our platforms, applications and services (user data, i.e. user activity and profile data)
  • Data on authorized persons and employees of suppliers, service providers that are legal entities: name and surname, address, contact details (email, telephone number), job position, legal entity, type of contract and service, data on the provision of the service
  • Data about individual service providers, such as engaged trainers: name and surname, address, unique personal number, payment data, type of contract and service, data on the provision of the service, financial and tax data, photos and videos for training program purposes, social media profile
  • User data (user activity and profile data)

Data about your user profile and your (online) user activities is automatically collected when you use our platforms, products and services.

Data about your user activities may include information such as the IP address of the device you use to log in to our platforms, the type and version of the browser software you use to access our platforms and services, the pages you visit on our platforms, the date and time you log in to our platforms, the duration of your visit to our platforms, unique identifiers of the device you use to log in, and other diagnostic data about your online activity on our platforms and access to our services.

When you access our platforms and services via a mobile device, we may automatically collect certain data, including the type of mobile device you use, the unique ID (identification number) of the mobile device, the mobile device operating system, the type of mobile internet and browser software you use, and other identifiers and diagnostic data about your mobile device.

We may also collect data that your browser software sends each time you access and use our platforms and services.

  • Data collected from third parties – social media

We may collect and use personal data that you have shared by creating a profile and/or otherwise interacting in the public domain with third parties – social networks. We may also contact you through third parties – your social media profiles to initiate communication and potential collaboration with you.

You can also create an account and log in (access) to use our platforms and services through your social media profile or when you as part of testimonials voluntarily share with us your positive experience with our programs and services.

  • Data collected while using the Fitkit app

When using our Fitkit.app application, we may, with your prior permission/consent, collect information about your (geographical) location in order to provide you with better and easier use of all the features of our application, and to improve, enhance and customize the application and the products it offers, as well as other services we offer you. You can enable or disable access to such data at any time by adjusting the settings on your mobile device.

  • Tracking technologies and cookies

When you visit our platforms, use the Fitkit application, register for and use your user profile, or request further information about the Fitkit platforms and services, we automatically collect data using cookies and tracking pixels. The data collected in this manner is used by us and our partners to analyze the movement on our platforms and usage trends of our products and services, to manage our online platforms (websites, applications, social media profiles) – either independently or with the assistance of hosting service providers, as well as to collect data about the users of our services and platforms.

Technologies we use to track activity on our platforms and collect information necessary for the analysis, evaluation, and improvement of our platforms and the services we offer may include: beacons, tags, and scripts.   • Purposes for using your personal data

We may use your personal data for the following purposes:

  • To provide and maintain our platforms and services, including monitoring the usage of our products and services.
  • To maintain your profile in our application: to carry out your registration and manage your profile as a user of our platforms and services. The personal data you provide when registering a Fitkit profile gives you access to various features, products and services of the Fitkit application.
  • To enter into and fulfill contracts (fulfilling contractual rights and obligations): for entering into and executing service agreements, work contracts, and other contracts we conclude with partners to provide the products and services we offer to you, as well as other contracts we conclude to maintain our platforms and provide our services and products. For access to and use of certain products on the Fitkit application, we may request that you provide additional personal data.
  • To communicate with you: To contact you by email, phone, SMS, or otherwise through an equivalent electronic communication methods (for example, through notifications via the Fitkit application) in order to inform you about updates to our services you use, or for other types of informational communication regarding the functionality of our products and services you use through our platforms (including security system updates).
  • To manage and respond to your requests: To receive, review, resolve, and respond to your requests addressed to us.
  • To promote our services and activities by sharing your experience using the services through our website or social media.
  • To deliver targeted marketing offers to you: We may use your personal data to develop and place promotional material (information, special offers, news) for other products, services and events that match your interests and preferences, and/or location, but only if you have previously voluntarily agreed to such processing when you registered as a new user or when using your online profile.   • Legal basis for processing your personal data

We may process personal data in the following cases, on the basis of:

  • Consent: You have given us consent to process your personal data for one or more specific purposes, such as direct marketing of services and products, sharing your experience as a user.
  • Performance of a contract : The processing of personal data is necessary for the fulfillment of a contract we have concluded with you, including all pre-contractual rights and obligations preceding the conclusion of such contract.
  • Legal obligations: The processing of personal data is necessary for the fulfillment of the Company’s obligations in accordance with the law, such as tax obligations or requests from state authorities pursuant to the law.
  • Legitimate interests: The processing of personal data is necessary for the realization of the Company’s legitimate interests, such as protecting business operations and the website (problem detection, data analysis, testing, security and support of systems and applications, data hosting and reporting), managing and cooperating with service providers, conducting court proceedings for collection, improving our services and products.
  • Disclosure and transfer of your personal data to third parties
  • With service providers: We may share your personal data with service providers we work with, including for maintaining our platforms and services, processing payments for the use of our services and products, production companies or telecommunications operators for the recording and display of video materials.
  • With collaborators: We may share your personal data with our collaborators, who are required to act in accordance with this Privacy Policy, such as IT consultants and developers who assist us in maintaining and upgrading the Fitkit application.
  • To create promotional content: We may share your personal data with marketing agencies and other service providers with whom we collaborate to create and send promotional content to you personally via email and/or to create our promotional material and marketing offers that appear when you use third-party platforms.
  • With business partners: We may share your personal data with business partners for the purpose of providing and offering our products, services and promotions to you as well as from fitness consultants and trainers whose services and advice we use to achieve and improve the fitness products and wellness offerings we offer to our clients, legal entities whose premises, products and services we use as services and products that are included in the use of the Fitkit application and/or Fitkit packages.
  • With other users: We may share your personal data that we have obtained through your activities in the public domain with other users and third parties – social networks. This is limited to personal data that is publicly available on your social network profiles (name, photo, description of your activities on the platform), and for the purposes of realization and/or improving communication and collaboration with you and sharing user experience.
  • Based on law and other legally binding requirements: In some circumstances, we may be obliged to share your personal data upon request by law and/or public authorities (courts, government agencies, enforcement agents). We may share your personal data when it is necessary to exercise and comply with our legal obligations, to protect and defend our rights and property, to prevent and/or investigate (possible and/or potential) abuse of our platforms, products and services, to protect the personal safety of our users/customers and/or public safety, acting in accordance with our legal duty and responsibility.

Our relationship with third parties is governed by an Agreement, which regulates the rights and obligations regarding the protection of personal data and the technical and organizational measures for the security of your personal data.

Personal data may be transferred to third countries outside the European Union or the European Economic Area. This may be in the context of, for example, our use of third-party services and platforms located in the United States. In such cases, we aim to ensure that the parties whose services we use from third countries comply with legal and contractual standards for personal data processing and take appropriate organizational and technical measures to preserve the security of personal data during processing.

For this purpose, we conclude data processing agreements with service providers in/from third countries, which regulate the transfer of personal data to third countries and may include standard contractual clauses issued by the European Commission for data transfers to third countries, and/or reciprocal standard clauses issued by the Personal Data Protection Agency.

Fitkit stores your personal data in the manner and for the purposes set out in this Privacy Policy for the duration necessary to achieve the purposes set out therein, unless the law permits or requires their storage for a longer period.

When your personal data is no longer needed to achieve the purpose for which it was collected and processed, we delete it in a timely and secure manner.

We may continue to store your personal data longer than the specified retention period, if this is necessary for the exercise of your and our legal and contractual rights and obligations, as well as for the resolution of disputes and the exercise of rights and obligations that we have towards third parties, to achieve our legitimate interests (for example, for realization of business goals, improvement of our products, maintaining competitiveness in the market, conducting legal proceedings, etc.), as well as for the harmonization of our security measures and standards regarding the security, integrity and operability of the Fitkit application and our other platforms, services, and products.

Your data may be subject to automated decision-making based on information about your preferences, previous interaction with us and use of the services, or demographic data in order to deliver marketing offers that best match your interests, but only with your prior consent.
